ICJ expresses concern over Gaza situation, denies emergency measures against Germany's support for Israel

In a recent development, the International Court of Justice (ICJ) has expressed deep concern over the dire humanitarian situation in Gaza while opting not to enforce emergency measures against Germany's support for Israel.

During a session held in The Hague, ICJ President Nawaf Salam acknowledged Germany's adherence to major international arms control treaties and its recent decision to limit arms exports to Israel.

"With a vote of 15 to 1, the court has concluded that the current circumstances do not necessitate the exercise of its power under Article 41 of the statute to recommend provisional measures," stated Salam.

Nevertheless, Salam underscored the ongoing apprehension of the ICJ regarding Israel's military operations in Gaza, which have resulted in civilian casualties, extensive property damage, and forced displacement of a significant portion of the population.

"The court remains deeply troubled by the severe living conditions faced by Palestinians in the Gaza Strip, particularly the prolonged deprivation of essential resources," he emphasized.

Last month, Nicaragua filed a case against Germany, accusing the country of contributing to genocide against Palestinians in Gaza through political and military support to Israel. Nicaragua's plea requested emergency measures to halt Germany's arms exports to Israel and reinstate funding for UNRWA, which Germany had previously suspended.

Germany refuted the allegations, asserting that its arms exports to Israel underwent thorough scrutiny and were deemed appropriate. The legal team representing Germany highlighted a significant reduction in arms exports to Israel, from €200 million in October 2023 to approximately €24 million in November 2023, and only €1 million in March 2024.

Additionally, the court took note of Israel's request for tank ammunition from Germany in 2023, which remains pending.

While denying Nicaragua's request for provisional measures against Germany, the ICJ allowed the case to proceed and reminded all nations, including Germany, of their obligations under international conventions regarding arms transfers during armed conflicts.

"The court emphasizes the importance of adhering to international obligations concerning arms transfers to parties involved in armed conflicts," Salam emphasized. "These obligations extend to Germany as a signatory to relevant conventions in its arms supply to Israel."

Since October 7, 2023, Israel has conducted a military campaign in Gaza following a cross-border attack by Hamas, resulting in approximately 1,200 fatalities. Over 34,500 Palestinians, predominantly women and children, have been killed, with thousands more injured and widespread infrastructure damage.

After over six months of conflict, extensive areas of Gaza remain in ruins, prompting 85% of the enclave’s population to seek internal displacement amid severe shortages of essential resources due to a blockade, as reported by the UN.
